Test Ride Agreement & Liability Waiver

This Test Ride Agreement (“Agreement”) is entered into with:

Electric Pedals Inc., a Delaware Corporation,
doing business as E-Lux Electric Bikes (“Company”)

1. Acknowledgment of Risk

I understand that operating an electric bicycle (“e-bike”) involves inherent risks, including but not limited to:

  • Loss of control

  • Collisions with vehicles, pedestrians, or objects

  • Mechanical or electrical failure

  • Road, terrain, or surface hazards

I voluntarily assume all risks, known and unknown, associated with operating the e-bike.

2. Test Ride Rules & Restrictions

I agree that I will:

  • Ride ONLY within the designated test ride area (parking lot use only unless otherwise approved)

  • Follow all instructions given by Company staff

  • Operate the e-bike in a safe and controlled manner

  • Not carry passengers

  • Not engage in stunt riding, racing, or reckless behavior

3. Rider Certifications

I certify that:

  • I am physically capable of safely operating an e-bike

  • I have prior bicycle riding experience

  • I am not under the influence of drugs, alcohol, or impairing substances

  • I will wear a helmet if provided, or I accept full responsibility if I decline

4. Damage & Financial Responsibility

I agree to be financially responsible for any damage, loss, or theft of the e-bike or related equipment caused by:

  • Negligence

  • Misuse

  • Violation of this Agreement

I authorize the Company to recover repair or replacement costs, up to the full retail value of the e-bike if necessary.

5. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, and discharge:

Electric Pedals Inc., E-Lux Electric Bikes, and their owners, officers, employees, agents, and affiliates

from any and all claims, liabilities, damages, injuries, or losses arising out of or related to my participation in this test ride.

6. Indemnification

I agree to indemnify, defend, and hold harmless the Company from any claims or damages brought by third parties arising from my actions during the test ride.

7. Binding Legal Agreement

By signing below, I acknowledge that:

  • I am entering into a legally binding agreement with Electric Pedals Inc., regardless of any trade name or branding used

  • I have read and fully understand this Agreement

  • I voluntarily accept all terms and conditions
